Brazilian Court Upholds Operation of Betnacional, Mr. Jack Bet, and Pagbet Amid Child Protection Lawsuit

The Court of Justice of the Federal District and Territories has ruled for the continued operation of online betting platforms Betnacional, Mr. Jack Bet, and Pagbet, which are operated by NSX Brasil.

This decision follows a lawsuit filed by Educafro Brasil and the Padre Ezequiel Ramin Human Rights Defense Center, seeking to suspend the platforms and collect 500 million reais in moral damages. The plaintiffs alleged that the platforms didn’t adequately protect children and adolescents from online gambling. 

Legal Defense Cites Industry Standards and Responsibility

The defense for NSX Brasil was led by lawyers Bernardo Cavalcanti Freire and Leonardo Henrique Roscoe Bessa, partners at Betlaw, a law firm specializing in legal matters for the betting industry.

The biometric verification system, central to the case, was presented as a key compliance feature by NSX Brasil. This technology ensures that users are of legal age by matching personal identification data with facial or fingerprint recognition.

Court Finds NSX Brasil Compliant with Regulatory Requirements

The court has determined that NSX Brasil met the regulatory requirements by the Ministry of Finance. According to the ruling, the company successfully demonstrated it had obtained the mandatory operational authorization and had implemented biometric systems to restrict underage users.

“Considering that it was proven, in the records, that the defendant obtained the authorization to operate for a period of five years, it is concluded that the security mechanism indicated by the plaintiffs themselves and required by the Ministry of Finance was duly implemented,” stated the court in its decision.

Case Remains Active Amid Calls for Further Scrutiny

Despite the ruling in favor of NSX Brasil, the case remains active. The court has invited the plaintiffs to submit new evidence demonstrating flaws in the biometric systems on the betting platforms. So, they must justify their access request for the company’s financial and user registration data, which could potentially uncover other breaches.

The outcome of this case will set a significant precedent for Brazil’s regulated betting industry. This sector has been transforming rapidly and facing scrutiny since more formal government rules were introduced. The legal challenges underscore tension between industry growth and a demand for protective measures.

While this ruling is a temporary win for NSX Brasil and the whole industry, it signals that ongoing monitoring and legal regulation will be key to Brazil shaping its online betting landscape. For now, Betnacional, Mr. Jack Bet, and Pagbet can continue operations. However, the larger debate about responsible gambling and child protection remains firmly on the national agenda.
