Brazil Launches Public Consultation on Revised Betting Licensing Rules

Brazil’s Secretariat of Prizes and Bets has opened a consultation to support a revision of the country’s betting licensing framework. The regulator published Public Consultation Notice No. 3/2026 on Wednesday, inviting contributions to shape a decree covering authorisation requirements for sports betting and online gaming operators.

The review forms part of the SPA Regulatory Agenda established through Ordinance No. 817 in April 2025. This agenda scheduled an assessment of the operator authorisation process for the first quarter of 2026, although the consultation has only now been launched.

The SPA said the process will focus on improving the application procedure created under SPA/MF Ordinance No. 827/2024. This ordinance set the conditions and requirements for companies seeking approval to operate betting businesses in Brazil.

Consultation will reflect lessons from the first licensing cycle

The regulator plans to use consultation feedback and lessons from the first authorisation cycle. Anyone may submit contributions through the Portal Brasil Participativo using a gov.br account. This consultation will remain open for 45 days, running from 27 July to 9 September.

Once the submission period closes, the SPA will review the contributions in line with Article 31 of Decree No. 12,002/2024. The resulting proposals will guide changes to current licensing rules and may affect how future operators apply for authorisation.

Transparency drive expands across Brazil’s betting market

Furthermore, the consultation comes as the Ministry of Finance increases transparency around the licensing process. In June, Finance Minister Dario Durigan said the government would publish more than 25,000 documents connected to betting authorisations.

Earlier in the week, the ministry issued Administrative Order No. 2,126, creating a task force focused on improving transparency in gambling company licensing procedures.
