VNLOK Threatens Meta With Legal Action Over Illegal Gambling Ads

Meta is facing legal action from Dutch gambling trade body VNLOK over claims that illegal gambling adverts keep appearing on Facebook and Instagram.

VNLOK, whose members include bet365, Unibet and LeoVegas, said it is preparing a formal complaint to the European Commission. The group argues that Meta has failed to take a proactive approach to stopping illegal gambling promotions targeting Dutch consumers.

The trade body said the issue undermines the licensed sector, where operators face tighter rules, higher taxes and a future ban on online gambling advertising.

“Meta’s measures fall short structurally, while vulnerable groups – including young people – are massively affected by illegal gambling advertisements,” VNLOK said.

VNLOK Says Meta Only Acts After External Alerts

VNLOK said Meta has “refused to enter into a substantive conversation for quite some time”. The trade body described Meta’s approach as “mops with the tap on”, arguing that the platform mainly responds after third parties flag illegal ads.

“Meta does ask for examples of illegal advertising, but does not want to work together to develop structural solutions. That is incomprehensible.

“Illegal providers keep returning with new ads…Large online platforms are required by law to continue investing in detection, monitoring and limitation of illegal gambling ads aimed at Dutch consumers.

“As long as Meta does not comply with its legal obligation, the illegal market will continue to grow and vulnerable players will be exposed to major risks. That is why we are now going to court and to Brussels.”

Complaint Will Focus On Digital Services Act Duties

VNLOK is expected to frame Meta’s conduct as a potential breach of the European Digital Services Act. The DSA requires large online platforms to act against illegal content and limit the spread of unlawful material, including advertising targeting consumers in breach of national laws.

If a court finds violations, Meta could be ordered to improve compliance and face daily penalties until breaches are resolved.

VNLOK also wants the European Commission to investigate, which could lead to further sanctions if DSA failures are established.

Illegal Gambling Pressure Continues Across Europe

The Netherlands has seen concern over illegal gambling activity as operators adjust to stricter regulation and tax pressure.

VNLOK’s move follows criticism of Meta in Europe, including the UK, where illegal gambling advertising has attracted scrutiny. For Dutch operators, the issue is whether platforms can be forced to take responsibility for gambling ads reaching vulnerable consumers.

The Dutch gambling trade body is suing Meta for allowing illegal gambling ads to its users in the Netherlands. This case hinges in the social media platform breaching the European Digital Services Act. Meta will need to improve compliance or be fined if violations are found in court.
