Evolution Sued for Supposed Patent Infringement in Lightning Games

Jumbo Technology, a gaming equipment maker from Taiwan, has started a lawsuit about patent infringement against a well-known live casino company. The claim says Lightning-branded games are using Jumbo’s special “dynamic raised odds” innovation. On May 29, in the US District Court for the District of Delaware, Jumbo filed its complaint and accused Evolution of breaking US Patent No. 9,646,459, which was given in 2017. This patent covers a system where games like roulette, baccarat, and dice get random bonus odds.

In their letter, Jumbo’s legal team explained how the patented idea helps players stay more interested, play for longer, and enjoy games that shift from basic and fixed to lively and not so predictable. When talking about online gambling, the lawyers said that having dynamic raised odds makes classic games much more thrilling and unexpected. This feature, according to Jumbo, works by giving players an occasional chance at higher payouts but still lets the casino operators keep making money.

Jumbo also mentions that they hold the patent rights for this game feature. Since 200, this Taiwanese company has supplied the Asian gaming industry and insists its patented invention supports many best-selling games from the live casino giant. There are games like Lightning Roulette, Red Door Roulette, Lightning Baccarat, and Lightning Dice, and each offers random multipliers that boost how much players can win on some bets.

Back in June 2024, Jumbo said it warned Evolution about possible patent infringement and offered a patent license at a fair royalty price. From the claim, it appears both sides exchanged some messages, but Evolution decided against a license and kept operating the games throughout US states such as Delaware, West Virginia, Pennsylvania, New Jersey, and Michigan.

According to the lawsuit, Evolution’s infringement has been “wilful, deliberate, and intentional,” because it kept using the patent even after knowing about it. Because of this situation, Jumbo now wants damages, extra compensation because of the wilfulness, and also wants their lawyers’ fees covered. One example in the complaint is a roulette game, where a payout that usually pays 35:1 could be raised to 42:1 using the patent’s technology.

There are also similar payout increases in baccarat and sic bo, where different multipliers are linked to certain bets and are adjusted based on probability so the casino’s advantage stays intact. Jumbo’s filing further claims Evolution did indirect infringement by getting others, including licensed US casinos and game operators, to offer these disputed games to players.

The company also believes Evolution showed off Lightning games at events like G2E Las Vegas, trying to get US market attention. This court case is the newest legal fight for Jumbo in the United States, following another patent dispute against Light & Wonder.
