The legal battle between Evolution and Black Cube continued in New Jersey this week as both sides secured limited procedural victories ahead of trial. The dispute, which rocked the industry last year, centres on black market allegations connected to live casino operations.
Court filings show neither party has moved toward settlement discussions, which might be a better option for Evolution. The controversy gained fresh attention in October 2025 when it was revealed that Playtech had commissioned the Black Cube dossier.
Court grants Black Cube access to additional materials
Judge John C. Porto issued several orders requiring Evolution to provide further documentation. Black Cube succeeded in convincing the court to approve its latest discovery requests, meaning Evolution must now hand over the Spectrum Gaming Report cited by the New Jersey regulators. The Swedish supplier is also required to produce materials shared with regulators and investigators, including files, transcripts and notes linked to meetings surrounding the probe.
Evolution had argued the renewed discovery push was to slow the process after earlier objections to additional disclosures. Black Cube countered that the request was a “narrowly tailored” step necessary to defend itself and challenge the conclusions drawn from the report. The decision ensures that new documents will enter the evidentiary record, potentially influencing each side’s arguments ahead of trial.
Deposition ruling offers Evolution partial relief
Evolution also achieved a procedural win as the court agreed to force Black Cube director Avi Yanus’ unfinished deposition. However, the judge denied their request to fast track a hearing under New Jersey’s anti-SLAPP framework.
The court ruled that unresolved discovery disputes and confidentiality issues must be addressed before scheduling can happen. This decision slows the timeline for defensive strategies while leaving the door open for future motions after fulfilling disclosure obligations.
Public statements signal confidence on both sides
Black Cube welcomed the latest developments, stating: “Black Cube is pleased with the court’s recent ruling and eagerly anticipates Evolution’s production of the full discovery materials, which Evolution has long resisted providing.
“We are confident that these disclosures will substantiate Black Cube’s prior reports and submissions in their entirety, demonstrating that Evolution has made its games available in sanctioned countries and black markets.”
Furthermore, a spokesperson for Evolution also previously commented on the case. “When these allegations were brought to our attention, we undertook a thorough investigation and fully and transparently cooperated with the regulatory investigations. We have nothing to hide and are confident in our compliance policies and processes.”
